공동주택 입주자들의 생활 수준 향상 및 고품질 기대로 인해 공동주택 하자와 관련된 민원이 매년 증가하고 있다. 그리고 이와 동시에 입주자들의 권리 주장에 대한 하자손해 배상 소송 또한 매우 증가되고 있다. 이러한 소송의 시작과 끝의 변화를 확인하기 위해 최근 10년간 공동주택 세대수에 따른 전국 아파트 단지 하자소송을 모두 조사하였다. 초기에는 입주자와 시 공사 간의 의견 차이로 시작되었지만, 최근에는 하자에 대한 금액 보상의 권리주장으로 전문 법무법인을 통한 하자소송을 준공 후 2~3년 차에 많이 제기하고 있다. 아파트 소유자들은 많은 판결금을 기대하고 시작하지만 민사로 소송결과까지 많은 시일이 걸리고 그 판결금에 대한 만족도는 35% 내외로 나타났다. 게다가 소송 진행 중에는 하자보수를 시공사가 제공하지 않아서 80% 가까운 입주자들이 불편하다고 하였다. 판결금 확정 큰 기여도는 사용전 검사에 대한 손해배상 청구가 많은데 시공사들은 이 부분에 대해서 품질을 개선하고 준공도면을 보완하여야 된다. |

Due to the rapid increase in the price of apartment houses by around 15% every year in 2021-2024 and the resulting increase in expectations for quality, defects disputes has been steadily increasing. Residents are focusing on securing their own rights by actively complaining about defects in the houses with expectations for rising construction costs. Residents’ claims are considered for validity to secure their rights, but resolving defects through litigation takes a long time to receive a judgment and has less practical benefits compared to to the appraised value claimed. Also, the construction company stops repairing defects, causing inconvenience to residents. Therefore, this paper analyzes the characteristics of the types of defects in apartment houses in Korea completed for 10 years and the judgments amounts and examines the actual amounts paid to residents. We also want to present the satisfaction with the results by conducting a survey on residents who participated in the defect litigation. |
