본 연구는 공공건축의 정책과 제도를 효과적으로 추진하기 위해 공공건축의 규범을 정립할 필요에 의해 기획되었다. 이를 위해 현행 법규의 공공건축 관련 내용을 확인하고 공공건축의 개념 정의와 유형 분류의 대안을 제시하는 것을 연구의 목적으로 하였다. 현행 법규에서는 공공건축의 조성, 유지, 관리와 관련하여 다양한 규정이 존재하며 주요 내용에 따라 크게 세 가지 유형으로 구분이 가능하다. 공공자산을 효율적으로 관리하기 위한 규정은 ?국가재정법?, ?지방재정법?, ?지방공기업법?, ?국유재산법?, ?공유재산 및 물품관리법?, ?국가를 당사자로 하는 계약에 관한 법률?, ?지방자치단체를 당사자로 하는 계약에 관한 법률? 등에 포함되어 있으며, 공간환경을 구성하는 물리적 요소로서 건축물을 조성하고 효율적으로 관리하기 위한 규정은 ?건축법?, ?건축기본법?에 따른 '공공부문의 디자인업무지침', ?경관법?, '경관계획수립지침', ?건축서비스산업진흥법?, ?건설기술진흥법?, ?녹색건축물 조성 지원법?, ?신에너지 및 대체에너지 활용 촉진을 위한 지원법? 등에 포함되어 있고, 공공서비스를 제공하는 시설로서 서비스의 수준 향상을 목적으로 각종 공공시설의 계획·설치·운영에 관한 사항을 제시하는 규정은 ?국토의 계획 및 이용에 관한 법률?, ?도시·군계획시설의 결정·구조 및 설치 기준에 관한 규칙?, ?정부청사 관리규정?, '도서관 설치 및 운영 메뉴얼', ?고등학교 이하 각급 학교 설립·운영 규정?, ?공공디자인 가이드라인?, ?유니버설 디자인 가이드라인? 등에 포함되어 있다. 공공건축의 정의에 대하여 현행 법규에서는 "건축의 공공적 가치를 구현하고, 적정한 수준의 품격을 갖추"는 것을 목적으로 하고 있지만, 실제 규정에서는 '공공기관의 소유'로 한정하여 국·공유재산의 효율적인 관리를 추구하고 있다. 이러한 법적 규정과 지향하는 목적 사이의 간극을 해결하기 위해 본 연구에서는 공공건축의 개념을 공익성과 접근성을 고려한 공공적 가치, 그리고 소유·운영 주체의 범위와 공간적 범위를 고려한 공공건축의 대상에 따라 단계적으로 확대하여 정의하는 다음과 같은 방안을 제안하였다. 새로운 공공건축의 정의에 따라 공공건축의 용도와 공공적 가치에 의한 유형 분류를 시도하였다. ?건축법?의 건축물 용도 유형을 참고하여 제안하는 공공건축의 용도 유형은 (1) 국가 또는 지방자치단체 청사 등의 공공업무 시설, (2) 학교, 도서관, 연구소 등의 교육연구 시설, (3) 공연장, 박물관, 미술관 등의 문화 및 집회 시설, (4) 체육관, 운동장 등의 운동 시설, (5) 어린이집, 노인복지 시설, 청소년 수련시설 등의 복지 시설, (6) 병원, 장례식장 등의 의료 시설, (7) 공항, 기차역, 버스터미널, 자동차 검사장 등의 교통 시설, (8) 형무소, 군사 시설 등의 교정 및 군사 시설, (9) 공중화장실, 광장 및 공원 등의 간이 시설 등 기타 시설로 구분할 수 있다. 또한 공익성과 접근성을 고려한 공공적 가치에 따른 공공건축의 유형은 6가지로 분류가 가능하고, 이 유형의 구체적인 사례를 확인하기 위해 공공건축의 용도를 대응시켜 보면 다음과 같다. 본 연구에서 제안한 새로운 공공건축의 유형은 기존의 건축물에 맞춘 용도 유형과는 달리 공공건축의 정의에 따른 유형이라는 점에서 의미가 있으며, 공공적 가치의 수준에 따라 건축물을 구분할 수 있기 때문에 건축물의 용도와 차별되는 공공성 측면에서 공공건축의 성격을 파악하는 데에도 기여할 수 있을 것이다. 그리고 각 유형의 보편적 특성과 서로 다른 유형 사이의 차이를 통해 공공적 가치와 용도 사이의 관계를 확인할 수 있을 것이며, 공공적 가치와 용도를 조합하여 보다 구체적이고 세밀한 공공건축의 유형을 분류할 수도 있을 것이다. 본 연구에서 현행 관련 제도의 검토를 중심으로 공공건축의 개념과 유형을 살펴보았지만, 공공건축의 개념과 유형을 정립하기 위해서는 본 연구의 대안을 기초로 하여 관련 전문가들과의 충분한 논의를 거쳐야 할 뿐만 아니라 본 연구에서 다루지 못한 공공건축에 대한 다양한 성격을 함께 고려해야 할 것이다. 특히 공공건축 논의는 '건축의 공공성'으로 확장하여 관련 용어의 개념 정의와 함께 논의될 필요가 있다. 공공건축이 독립적으로 존재하는 것이 아니라 공공성, 공공공간, 공간환경 등 수많은 관련 개념과의 관계 속에서 실체적인 의미를 파악할 수 있기 때문이다. 더불어 공공건축의 개념에 대한 논의를 진전시키기 위해서는 구체적인 유형별 연구도 동시에 진행되어야 한다. 본 연구에서 제안한 공공적 가치에 따른 공공건축의 유형 중에서 공공업무 시설 등의 개별 유형에 대하여 대상 시설 범위의 변화 과정, 공공건축으로서 계획·유지·관리하기 위한 제도적 변화와 구체적인 관련 규정에 대한 논의, 현행 제도의 문제점과 개선 방향 등을 확인한다면, 점진적으로 공공건축의 특성을 규명하고 공공건축의 관리를 통한 기대효과를 확대해 나갈 수있을 것이다. |

This study was designed by the necessity of establishing norms of public buildings in order to effectively implement policies and systems of the public building. For this, the purpose of this study is to identify the contents of the public building system in current regulations and to suggest alternatives of the concept and types of public buildings. The current legislation on public building includes regulations for the efficient management of public assets, regulations for the construction and efficient management of buildings, and regulations for improving the level of public services. The current regulation also aims at realizing the public value of architecture and attaining appropriate level of dignity. However, in the definition of public building, it is limited to "ownership of public institution" and pursues efficient management of public property. In order to solve the gap between the legal regulations and the purpose of the regulations, this study proposed a stepwise expansion of the concept of public building considering the public value and the object of public building. Alternative concept 1(minimum scope): a building that is accessible to the general public through free or prescribed procedures, and that is owned and managed by public institutions for socially agreed benefits. Alternative concept 2(minimum scope): a building that is accessible to the general public through free or prescribed procedures, and that is owned and managed by public institutions for socially agreed benefits or supported by the public sector to promote the publicness. Alternative concept 3(maximum scope): a building-including spaces in a building or a public space that is accessible to the general public through free or prescribed procedures, and that is owned and managed by public institutions for socially agreed benefits or supported by the public sector to promote the publicness. In addition, we proposed new types of public buildings by classifying it into types according to use and public value. Use type of public buildings: Public facilities, Educational research facilities, Cultural and assembly facilities, Sports facilities, Welfare facilities, Medical facilities, Traffic facilities, Correctional and military facilities, and Other facilities. Public buildings can be also categorized into six types according to public values considering public interest and accessibility. The new types of public buildings proposed in this study is meaningful in that it is a type based on the concept of public buildings unlike the use type of the current Building Codes. This typology can contribute to the identification of public buildings in terms of publicness because it can classify buildings according to the level of public value. |
