지역건축기본계획의 성과와 실효성 확보를 위한 정책연구 / Strategies to Improve the Effectiveness of the Regional Archite ctural Policy |

광역시·도에서는 지난 5년간 건축기본법 제12조에 따라 활발히 광역건축기본계획을 수립하여 2010년 서울시 건축기본계획 수립을 시작으로 경기도, 인천, 대전, 부산, 충청남도, 전라북도, 제주도 등 11개 지자체에서 건축기본계획 수립을 완료하였으며, 광주광역시, 울산광역시, 세종특별자치시, 강원도, 충청북도 등 5개 지자체에서 건축기본계획을 수립 중이다. 국가건축정책기본계획은 건축기본법 제15조에 근거하여 매 2년마다 계획 이행여부를 점검하고, 국회 상임위원회에 보고하고 있는 반면, 지역건축기본계획은 서울, 경기, 부산등 지자체에서 자체적인 점검 TF팀을 구성하여 그간 성과를 일부 검토한바 있으나 일시적으로 진행된 것에 그쳤으며, 대부분의 지자체에서는 계획성과에 대해 체계적으로 점검하지 못하고 있는 실정이다. 국가 및 지역 건축정책이 체계적으로 관리·운영되기 위해 건축기본계획의 범위 및 내용, 추진체계, 예산계획 등 기존 계획방식에서의 행정적, 제도적 문제점과 원인을 분석하고, 실효성 있는 계획으로 발전하기 위해 필요한 법제도 개선, 관련 계획 간의 관계 정립, 지역건축기본계획 수립지침의 수정, 계획의 성과관리체계를 구축할 필요가 있다. 또한 이를 기반으로 지역건축기본계획에 대한 그간의 성과를 종합·분석하여 계획이 보다 체계적으로 관리되고, 실효성을 확보하기 위해 개선되어야 할 정책방향 제안이 필요하다. 본 연구는 지역건축기본계획의 범위 및 내용, 성과에 대한 분석을 통해 실효성 측면에서의 문제점과 원인을 도출하고, 계획의 실효성 확보를 위한 제도 개선 및 정책대안을 제안하고자 한다. 건축정책을 선행한 유럽국가에 비해 시작은 뒤늦었으나 그 동안 건축정책에 대해 목말라 온 현실에서 건축기본법과 건축기본계획이 지난 5년간 우리 건축계에 영향을 준 것은 실상 놀라운 것들이 많이 있다. 우선 건축을 '민간자산의 건축' 보다는 '국가자산으로서의 건축'으로 건축기본법의 근본 취지인 '건축의 공공성' 구현을 위한 정책을 마련하자는 합일된 건축계 전문가들의 공감대를 형성했다는 점은 건축정책의 가장 큰 성과 중 하나라고 볼 수 있다. 또한, 건축기본법의 취지에 부합하는 다양한 정책을 추진하고, 소기의 성과를 달성하였다. 건축기본법의 정책 실행을 위한 수단으로 크게 ①건축정책기본계획(제10조, 제11조)과 지역건축기본계획(제12조) 수립, ②국가건축정책위원회 구성(제13조), ③건축문화의 진흥을 위한 재정지원(제20조), ④건축디자인 기준의 설정(제21조), ⑤건축디자인 시범사업(제22조) 등 5가지로 구분될 수 있다. 광역시·도 단위의 지역건축기본계획도 활발히 수립되었으며, 녹색건축물 조성지원법, 건축서비스산업진흥법, 한옥 등 건축자산 진흥에 관한 법률, 도시재생 활성화 및 지원에 관한 특별법 등 다수의 건축관련 법률이 제정되어 각종 실태조사, 정보체계 구축, 기본계획 수립, 전담지원기구 설립·운영, 전문인력 양성 등 건축계에서 할 수 있는 정책과 일들이 많아졌다. 특히 건축정책 지원기구로서 건축진흥원, 공공건축지원센터, 국가한옥센터, 도시재생지원센터, 그린리모델링 창조센터 등 다양한 기구 설립의 법적 근거를 확보하였으며, 이들 기구가 향후 건축·도시환경을 비롯한 건축업계에도 큰 변화를 줄 것으로 예측된다. 이장에서는 지역건축기본계획이 수립 완료된 11개 지자체 계획에 대한 계획수립 과정, 현황 및 여건변화 부문의 조사항목, 계획부문별 주요 정책 키워드, 실행주체, 계획에서 제안하는 전담지원기구의 기능 및 역할, 예산계획, 실행계획 수립 및 성과관리 체계마련 여부 등 지역별 계획 특성에 대해 분석하였다. 지역별 건축기본계획의 내용에 대해 심층적으로 분석한 결과 실행력을 담보하기 어려웠던 한계 및 원인을 파악할 수 있었다. 지역건축기본계획 문헌분석으로 파악하기 어려운 부분에 대하여 계획 수립과정에 참여했던 국가 및 지자체 담당 부서 실무자, 전문가 대상으로 지역건축기본계획 기능 및 역할과 계획 실효성에 대한 인식조사를 실시하였다. 설문조사는 ①계획수립 범위 및 내용, ②계획수립 방법과 절차, ③계획의 실효성에 대한 인식, ④계획 실행주체, ⑤실행력 확보를 위한 의견, ⑥응답자 특성 등 6개 부문에 대한 설문조사를 설계하여 실시하였다. 관계실무자 및 전문가 인식조사 결과 계획의 한계와 실행력 부족 원인은 ①계획 구성 및 내용 자체의 문제, ②법·제도적 측면의 문제, ③실행주체 및 행정적 한계 등으로 파악되었다. 지역건축기본계획과 유사한 성격의 타 법정계획, 특히 기본법에 의해 수립되고 있는 중앙 및 지자체 단위에서의 타 분야 계획에서 실효성 확보를 위한 전략 및 계획 실행체계를 분석하고, 벤치마킹할 수 있는 사례를 조사하였다. 우수 계획사례에 대해서는 국가와 지자체간 위계별 계획 실행체계, 관련 법령 및 계획간의 관계 설정, 전담지원부서의 여부, 예산확보와 관련된 실행체계, 성과관리 체계에 대해 심층적으로 분석하고, 지역건축기본계획에 적용할 수 있는 시사점을 도출하였다. 법정계획 중 기본법에 근거하여 수립되고 있는 기본계획은 저탄소녹색성장 전략과 5개년계획, 에너지기본계획, 환경종합계획, 여성정책 기본계획, 국토종합계획, 건설산업진흥 기본계획으로 총 6개를 조사대상으로 하였다. 그 외에 농어업인 삶의 질 향상 및 농어촌 지역개발 5개년 기본계획, 농어촌 보건복지 기본계획과 건설기술진흥 기본계획 등 3개를 조사대상으로 더하였다. 건축정책기본계획과 유사한 성격의 타분야 법정계획의 실행 및 관리체계를 살펴보기 위해서는 법정계획에 대한 근거법과 관련법, 관련계획에 대한 위계를 파악하는 것이 우선 되어야 한다. 따라서 조사 대상으로 삼은 9개 근거법에 따라 기본법과 특별법으로 구분하고, 근거법의 특성에 따라 중앙정부, 지방자치단체 차원의 법정계획을 하나의 세트로 하여 관련 법령과 계획간 위계를 분석하였다. 법정 기본계획 실행을 위한 전제로서 기본계획 자체의 수립과정을 분석하되, 수립과정은 계획수립주체, 심의기구, 관련 위원회, 별도 추진계획과 시행계획 유무 등을 조사하여 분석하였다. 또한, 각 기본계획 실행을 위한 중앙 및 지자체 단위의 전담부서 운영, 예산확보 전략을 중심으로 실행과정을 분석하였다. 그리고, 법정 기본계획 실행의 마지막 단계로서 추진상황 점검 및 성과평가 체계에 대해 조사하였다. 기본계획 추진의 실효성 확보를 위한 방법으로 개별 계획들의 평가주체와 평가내용, 평가관리 등으로 나누어 성과관리시스템으로서 작동하는지 확인하였다. 건축정책을 선행한 유럽 주요국의 정책내용을 분석해 보면 국내의 건축정책과는 달리 다루고 있는 정책대상이 '건축문화', '공공건축', '건축기술'에 주요 초점을 맞추고 있다. '건축'의 범위를 축소하자는 의견이 아니라 그동안 소외되고, 정책적으로 다루지 못했던 부문에 대해 초점을 두어 건축기본계획만의 차별성을 가질 필요가 있다. 건축정책기본계획의 목적달성은 특정 시설과 공간에 대한 계획이 아닌 법규, 행정프로세스, 설계발주 및 계약, 지침 및 기준, 건축기술, 교육 등 정책수단의 개선을 통해 건축수준을 향상하는 것에 초점을 두고 있다. 주택종합계획, 도시기본계획, 건설기술진흥기본계획, 건설산업진흥기본계획 등에서 다루는 정책대상인 주택공급, 도시기반시설 SOC 등은 과감히 건축정책 대상에서 제외할 필요가 있다. 지역별 건축기본계획 주요내용을 분석한 결과, 실질적으로 지역차원에서 해결할 수 없는 정책과제를 계획내용으로 포함하고 있는 경우가 상당부분 발견할 수 있었다. 지역단위에서 추진가능한 정책대상 여부를 계획 수립시 가장 먼저 고려할 필요가 있다. 국가계획과 지역계획의 차이를 둔다면, 국가단위에서는 특정한 공간적 범위를 염두해 두고 계획을 수립하기 어려운 제도적 측면, 행정프로세스, 기술개발 등에 초점을 둔다고 한다면, 지역단위에서는 실질적으로 공간상에 계획이 실현될 수 있는 가능성이 있기 때문에 지역현황 및 공간여건을 충분히 고려하여 계획이 수립되어야 한다. |

Architecture policy in Korea has been initiated since the enactment of Architectural Framework Act in 2007. Although the enforcement was relatively late compared to foreign countries, especially European ones, the Architectural Framework Act and Basic Architectural Planning brought a number of remarkable facts that caused great impact to our architecture industry over the past 5 years. The legislation related with built environments, such as Support for Green Building Act, Architectural Service Industry Promotion Act, Architectural Property Promotion Act and Urban Restoration Activating & Support Act could contribute more on policies or projects such as the research on the actual condition, establishment of information system & master planning, founding & managing organization exclusively for support and training professional manpower. Since the local architectural plans in Metropolitan city have been actively established, 14 local governments including Seoul, Gyeonggi, Busan, Jeonbuk, Chungnam have completed or are now in progress of establishing their Basic Architectural Planning. The Local Architectural Planning were established out of obligation by the local government based on the Architectural Framework Act, but this had not been implemented systematically because of the institutional and administrative limitations. Therefore, many practicing professionals have many doubts concerning the policy effect which has been performed since the establishment of the Local Architectural Planning and even of the plan itself. This study points out the problems and the causes in terms of effectiveness of the plan by analyzing the scope and contents of Local Architectural Planning and results. Furthermore, it suggests the policy improvements and alternatives to secure the effectiveness of Local Architectural Planning. This study deeply analyzed the content of Local Architectural Planning and carried out the survey on the recognition of state department & local governments and professionals about the functions, roles, and effectiveness of Local Architectural Planning for the parts hard to approach by documents. The result of analysis showed that the limitation of the plans and the short of execution power came from ①the contents ②Legal and institutional problem ③ the limitation of agents who implement the plan and administration. There were some problems of the plans' contents themselves. At first, the Local Architectural Planning has unclear relationship with other plans on other fields which makes it ambiguous. Second, the research was too general and formal to fully comprehend the local issues. Lastly, the plan was also hard to be differentiated due to the shortage of local government's budget. From legislative and institutional viewpoint, there have been repetitions and contradictions among the new legislations since the enactment of the Architectural Framework Act and reset of the scope of plans. Lastly from the limitation of agents and administration, the point of the plan establishment was uncertain; the personnel who has an exclusive role to perform and manage the plans was not exist; assignments that each personnel has changed too often to carry out their work well-organized; and lack of interdependable cooperation among departments. In order to solve these issues, this study analyzed some strategies and implementation system operated in other fields' legal plans similar to the Local Architectural Planning, especially established by fundamental law of the federal and local government. Moreover, it made the benchmarking study and deeply analyzed ; some well-performed plans focusing on the plan performing system between federal and local government based on their hierarchy, the establishment of relationship between related laws and plan, existence of the department exclusively for support, implementation system associated with budget secure and performance management system. The study brought up points that can be adopted as the Local Architectural Planning. The study suggests that architectural policy targets and scopes reset and legislation and plans reorganize to secure the effectiveness as the Local Architectural Planning. It also defines the role of new institution and relationship with others and suggests the assessment system to make stable performance management on architectural policy in accordance with the associated legislation. Based on the study, revision direction of Architectural Framework Act and the guidelines of Local Architectural Planning are presented to secure the effectiveness of comprehensive planning. |
