제1장 서론. 2010년 제정된『저탄소 녹색성장 기본법』에서는 녹색건축물의 확대를 위한 정책을 시행하도록 규정하고 있다. 하지만 현재 건물 에너지는 『에너지이용합리화법』, 친환경 건축물은 『건축법』에 일부 규정되어 개별적 시책으로 다루어지고 있다. 또한 친환경인증, 주택성능등급표시, 에너지효율등급, 친환경주택 건설기준 등 다양한 제도들이 건축법, 주택법, 에너지이용 합리화법, 신에너지 및 재생에너지 개발·이용·보급 촉진법 등 녹색건축물과 관련된 사항이 개별법으로 운영되고 있어서 사회적 비용 증가하고 있다. 따라서 녹색건축물 활성화의 효율적 추진과 체계적인 운영을 위해 전문법령을 마련해야한다. 제2장 녹색건축물 관련 정책 현안. 현재, 녹색건축 관련 규정의 문제점은 외국기준에 비해 현저히 낮은 건축물에 대한 성능규정과 강제력이 적어 실효성 또한 매우 낮은 정부주도의 각종 인증제도이다. 녹색건축물 조성을 지원하는 제도는 친환경건축물인증(건축법), 주택성능등급표시(주택법), 에너지효율등급(에너지이용합리화법), 에너지목표관리제 등이 대표적이다. 친환경건축물인증의 경우 공공건축물을 대상으로 확대하고 있지만 에너지와 탄소배출에 대한 기준이 비교적 적으며, 주택성능등급표시나 에너지 효율등급 등은 등급 인증을 통해 사업자나 사용자가 얻는 이점이 적어 보편적 확대가 어려운 실정이다. 최근 녹색건축물 관련 정책적으로 건축물 에너지 기준 강화, 공공건축물의 친환경 인증 및 에너지효율 개선, 건축물 사용자의 에너지 사용절약을 ‘유도’하는 사업을 추진해 왔다. 또한 신규 대형 건축물의 경우 온실가스·에너지 목표관리제 시범사업을 시행하고 있으며 이를 통해 사회 전반에 에너지 및 온실가스 배출 관리에 대한 중요성 인식이 확대되고 있다. 그러나 소수의 대형 건축물보다 건축물의 대부분을 차지하는 기존 주택과 상업시설에 대한 관리는 미비한 실정이다. 주택에 관한 에너지 관리는 시범사업 이외에는 시도되지 않았으며 주택의 표준 에너지 사용량 및 탄소배출제로 등의 기준 강화는 물론 이를 추진할 수 있는 법적 기반이 요구된다. 제3장 해외사례. 일본의 경우, 탄소 절감보다는 에너지 효율화에 중점적으로 정책을 추진해왔으며 기후변화 대응법과 합리적 에너지 사용에 관한 법을 개정하여 건축물의 에너지와 기후변화에 대응하고 있다. 특히 각종 에너지의 수급 및 관리를 추진하고 있는 기관 및 협회에서 주도적으로 에너지이용효율화에 대한 다양한 형태의 시설 설비 비용이나 금융 지원을 추진하고 있다. 이에 따라, 일반 주택 및 업무시설 등의 에너지 효율화 건축물로의 전환이 촉진되고 있다. 또한 에너지 관리와 녹색건축물 조성에 대한 계획 체계가 명확하지 않은 우리나라로서는 일본의 에너지절약법상 “원단위”, 용도별소비량 관리 등의 체계적이고 적극적인 PDCA관리체계를 검토되어야 한다. 영국의 경우, 에너지효율정책은 법에 기반하고 가스, 전기 등과 같은 직접적인 영향이 있는 법과 연동할 뿐 아니라 건축법, 주택법등과 연계함으로써 활용적 가치를 높혀 건축물의 에너지 효율에 근간을 마련하고 있다. 영국은 녹색건축물 활성화를 위해 법 제정, 정책 수립, 다양한 제도, 활용 프로그램을 통해 탄소제로화 목표를 달성하고자 하고 있으며, 영국의 녹색건축물 시장은 세계적으로 일찍 시작한 만큼 다양한 형태의 적용할 수 있는 시스템이 구축되어 있을 뿐만 아니라 이러한 것들은 실제 이용자들이 쉽게 적용할 수 있는 단계에까지 이르렀다. 미국의 경우, 세계적 기후 변화에 대응하여 녹색건축물 강제 규정 제정을 노력하고 있으나 2009년 ‘청정에너지 안보법안’이 미 하원을 통과 후 상원에서 끝내 처리되지 않는 등 법률 제정에 어려움을 겪고 있다. 현재는 미 에너지국의 Energy Star 등과 같은 자발적 인증시스템 관리 방안이 주를 이루고 있다. 워싱턴D.C.와 같이 LEED 인증 시스템과 법률을 상호 연동하여 쓰일 정도로 LEED로 대표되는 민간 주도의 친환경 인증 시스템이 널리 보급되어 이용되고 있다. 캘리포니아처럼 하나의 독자적인 시스템을 갖추어 적용하는 주도 있다. 제4장 녹색건축물 조성지원법의 주요내용. 녹색건축물 조성지원법(안)은 국가적으로 요구되고 있는 건축물에 대한 에너지기준 강화에 대응하고 온실가스 배출량을 단계적으로 축소하기 위한 내용을 담으려고 하였다. 또한 이를 지원하기 위해 녹색건축기술과 인프라를 구축함으로써 국가경쟁력을 전문성 있는 세계적 수준으로 강화하고, 지속가능발전을 추구하는 기반을 구현하기 위해 작성되었다. 이를 위해 법(안)에서는 에너지·자원 다소비형 건축물이 저탄소 녹색건축물로 단계적으로 전환되도록 규정하고, 새로운 녹색건축물의 창출, 기존 건축물의 녹색건축물로의 전환, 건축물 사용단계에서의 에너지효율개선 및 관련 산업과의 연계 등의 내용을 포함되도록 작성하였다.이 모든 것을 실행하기 위한 기본원칙은 온실가스 배출량 감축을 통한 녹색건축물 조성, 환경 친화적이고 지속가능한 녹색건축물 조성, 신·재생에너지 활용 및 자원 절약적인 녹색건축물 조성, 기존 건축물에 대한 에너지효율화 추진, 녹색건축물의 조성에 대한 계층 및 지역 간 균형성 확보하는 것이다. 녹색건축물 조성지원법의 주요내용을 살펴보면, 제6, 7조에서는 국토해양부장관은 녹색건축물 조성 촉진을 위하여 5년마다 녹색건축물 조성기본계획을 수립하도록 하고, 시?도지사는 녹색건축 기본계획에 따라 5년 단위의 녹색건축물조성계획을 수립하도록 하였다. 제 10조에서는 건축물 분야의 온실가스 배출 및 에너지 사용량과 관련된 정보 및 통계관리를 위하여 국토해양부장관은 건축물 에너지 및 온실가스 정보체계를 구축한다. 제11조에서는 건축법에 따른 허가권자는 관할 지역의 건축물에 대하여 에너지 소비 총량을 설정할 수 있고, 국토해양부장관은 허가권자가 에너지소비 총량을 달성하기 위한 계획을 수립하여 협약을 체결하면 해당 지방자치단체에 행정적?재정적 지원을 할 수 있도록 한다. 제12조에서는 국토해양부장관은 「저탄소 녹색성장 기본법」에서 정하는 건축 부문의 중장기 및 기간별 온실가스 배출량 목표 관리를 위하여 신축 및 기존 건축물의 에너지 소비 총량을 제한할 수 있도록 하며, 제15-17조에서는 친화적인 건축물의 공급 확대 및 에너지 성능이 높은 건축물을 확대하기 위하여 녹색건축인증제 및 건축물의 에너지효율등급 인증제를 시행할 수 있도록 하고, 허가권자는 녹색건축물의 건축을 활성화하기 위하여 대통령령이 정한 기준에 적합한 건축물은 용적률 등 건축기준을 완화할 수 있도록 한다. 제23조에서 녹색건축물 조성 기술의 연구·개발 및 보급은 효율적으로 추진하기 위하여 관련 전문기관을 녹색건축센터로 지정할 수 있도록 하고 업무수행에 필요한 자금의 일부를 예산의 범위에서 출연하거나 지원을 할 수 있도록 하였으며, 국가 등은 녹색건축물 조성을 위한 사업에 대하여 보조금의 지급등 필요한 지원을 할 수 있으며, 소득세·법인세·취득세·재산세·등록세 등을 감면할 수 있도록 하는 내용으로 구성하였다. 제5장 결론. 「저탄소 녹색성장기본법」에서 녹색건축물에 대하여 제시하고 있는 에너지 목표관리제, 녹색건축물 배출량 관리, 자금지원 등 구체화된 실행규정을 마련할 필요가 있기 때문에 녹색건축물의 조성에 필요한 사항을 정하고, 건축물 온실가스 배출량 감축과 녹색건축물의 확대를 위한 방안을 두는 종합적이고 체계적인 제도적 장치를 마련되어야 할 것이다. 또한 이를 지원하기 위해서는 녹색건축기술과 인프라를 구축함으로써 국가경쟁력을 전문성 있는 세계적 수준으로 강화하고, 지속가능발전을 추구하는 기반을 구현하기 위해서는 기존건축물과 신규건축물을 녹색화하기 위한 녹색건축물 조성지원법(안)이 필요하다. 법안의 구체적인 내용으로는 새로운 녹색건축물의 창출, 기존 건축물의 녹색건축물로의 전환, 건축물 사용단계에서의 에너지효율개선 및 관련 산업과의 연계 등을 통하여 현재 에너지·자원 다소비형 건축물이 저탄소 녹색건축물로 단계적으로 전환되고 확산될 수 있는 내용이 포함되어야 한다. 결론적으로 본 연구에서는 녹색건축물 조성지원법(안)의 주요내용을 총칙, 녹색건축물 조성 기본계획, 건축물 에너지 및 온실가스 관리 대책, 녹색건축물 등급제 시행, 녹색건축물 조성의 실현 및 지원의 법안내용을 검토하였다. 이러한 내용은 주된 목적은 녹색 건축물의 확산에 있다. 그러나 녹색건축물 조성은 지속가능한 건축의 실현을 위한 개인적 판단과 결정에 의해서 실행될 수 있는 것으로서 사회적인 측면이 우선시되어야 할 것이다. 녹색건축물의 조성에 필요한 사항을 정하고, 건축물 온실가스 배출량 감축과 녹색건축물의 확대를 위한 방안을 두는 제도 기반 구축 방안 연구를 토대로 실효성을 담보하기 위한 필수적인 조치로써 관련된 여러 부처와 다양한 부서의 공무원 조직의 체계정비가 필요하다. |

Chapter 1. Introduction. Whereas "Framework Act on Low Carbon, Green Growth" legislated in 2010 stipulates implementation of policies to expand green buildings, building energy is prescribed in "Energy Utilization Act", environment-friendly buildings partly in "Building Act", being treated as an individual policy. Also, diverse systems such as environment friendliness certification, housing performance rating system, energy efficiency rating, environment friendly housing construction criteria, are managed as an individual bill such as building act, housing act, energy utilization act, new and renewable energy development, use, spread promotion law, causing confusion and an increase in social cost due to non-systematic management, and hence requiring specialized ordinances for efficient pushing ahead of green buildings activation. Chapter 2. Policy Issues related to Green Building. As for policy issues related to green buildings, although projects for enforcing energy criteria for buildings, and improving environment friendliness certification and energy efficiency of public buildings as well as 'inducing' energy savings by the users have been implemented, the issues of policy regulations related to green buildings in our country include that performance specifications for buildings are remarkably lower than foreign criteria and various government-led certification systems are evaluated to have a limited legal force accompanied by very low effectiveness. In the case of new large buildings, a demonstration project of energy goal management for greenhouse gas In the case of is being implemented, through which recognition of the importance of managing energy and greenhouse exhaust is spreading throughout the society. However, management for existing housings and commercial facilities accounting for the most of buildings rather than a few large buildings is inadequate. Chapter 3. Oversea Case Examples. In the case of Japan, many environment-related policies are established and implemented to preserve earth environment, of which energy-savings- related legislation and policy of "energy savings law" has been established to regulate for energy usage by buildings that exerts much influence on degradation of earth environments. Construction Support Act(Plan) attempts to respond to enforcement of energy criteria for buildings as required countrywide and include the contents to reduce greenhouse gas exhaust stepwise. Also, it has been prepared to elevate the national competitiveness to a professional worldly level and provide a basis pursuing sustainable development through construction of green building technology and infrastructures to support this. For this purpose, the law(plan) stipulates so that high consumption type of buildings of energy and resources are converted to low-carbon green buildings stepwise, and has been prepared to include such contents as generation of new green buildings, conversion of existing buildings into green buildings, energy efficiency improvements at use stages of buildings, and liaison with related industries. The basic principles to implement all these is construction of green buildings through reduction in greenhouse gas exhaust, construction of environment friendly and sustainable green buildings, construction of green buildings with new and renewable energy utilization and resource savings, implementation of energy efficiency enhancement for existing buildings, and securing a balance between classes and regions for construction of green buildings. Considering major contents in construction support act for green buildings, in sections 6 and 7, the minister of Ministry of Land, Transport and Maritime Affairs is to establish basic plans for construction of green buildings every 5 years to promote construction of green buildings, and mayors and governors are to establish construction plans for green buildings according to the basic plan every 5 years. In section 10, the minister of Ministry of Land, Transport and Maritime Affairs is to construct an information system for building energy and greenhouse gas for management of information and statistics related to greenhouse gas exhaust and energy usage in the building area. In section 11, the permit authority according to the building act can set the total quantity of energy consumption for buildings in his/her jurisdiction area, and the minister of Ministry of Land, Transport and Maritime Affairs will provide the corresponding local government with administrative and financial support when the permit authority establishes a plan to achieve the total quantity of energy consumption and sign the agreements. In section 12, the minister of Ministry of Land, Transport and Maritime Affairs will be allowed to limit the total energy consumption for new and existing buildings for the goal management of greenhouse gas exhaust for mid to long term and per period as stipulated for buildings in "Framework Act on Low Carbon Green Growth". In sections 15-17, certification systems for green buildings building's energy efficiency rating are to be implemented to expand the supply of environment friendly buildings and high energy performance buildings, and the permit authority shall be allowed to alleviate building criteria such as floor area ratio for buildings complying with criteria set by Presidential order. In section 23, relevant professional organizations may be designated as the green building center to efficiently implement research development and dissemination of construction technology for green buildings, a part of the fund required for task execution may be appropriated or supported within a range of the budget, the government shall be able to provide necessary support such as the payment of grants, or the reduction in income tax, corporation tax, acquisition tax, property tax, etc. Chapter 5. Conclusion. Since specific implementation regulations for energy goal management system, green building exhaust management, funding support addressed for green buildings in "Framework Act on Low Carbon Green Growth" need to be prepared, comprehensive and systematic institutional apparatus should be provided including setting of provisions required for construction of green buildings and planning for reduction of greenhouse gas exhaust of the building and expansion of green buildings. Also, to support this, construction support act(plan) for green buildings for converting existing and new buildings into green is needed so as to enforce the national competitiveness to a professional worldly level through construction of green building technology and infrastructures, and materialize the basis for pursuing sustainable developments. As for specific contents of the act, stepwise conversion and expansion of high-consuming buildings in energy and resources into low carbon green buildings through generation of new green buildings, conversion of existing buildings into green buildings, energy efficiency improvements at use stages of buildings, and liaison with related industries should be included. In conclusion, major contents of construction support act(plan) for green buildings have been reviewed in the present study along with a basic plan for construction of green buildings, management measures for building energy and greenhouse gas, implementation of building rating system, bills for realization and support of green building construction. Main purpose of these contents is in expansion of green buildings. However, the construction of green buildings can be implemented by personal judgment and decision for realization of sustainable building and its social aspects should be given a priority. System maintenance of public officials' organization involving various ministries and departments is needed as an essential measure to guarantee an effectiveness on the basis of studies on construction plans based on systems with planning for reduction of building greenhouse gas exhaust and expansion of green buildings as well as setting of provisions required for construction of green buildings. |
