건설프로젝트의 수행과정에서 불명확한 설계서 및 현장 환경의 요인 등 불확실한 요인으로 발생하는 설계변경 및 클레임은 국내건설시장에서 증가하고 있는 추세이다. 설계변경으로 인한 클레임이 발생할 때에 계약당사자간의 해석차이로 인해 분쟁으로 악화되고 추가비용 및 공기지연 등의 문제점을 야기시킨다. 설계변경은 건설 클레임 발생의 중요한 요인의 하나이고, 그로 인해 계약금액을 조정하는 과정에서 계약 당사자인 발주자와 시공자(Contractor or Constructor)간의 분쟁이 많이 발생하고 있다. 본 연구는 국내 건설공사에서 발생하는 설계변경 클레임의 최근 10년간의 판례분석을 통해 그 쟁점과 판정결과 및 근거가 무엇인지 고찰해 보았다. 판례분석을 통해 국내공사계약일반조건 중 설계변경에 관한 조항과 분쟁해결 절차의 문제점이 무엇인지 조사하였다. 이러한 문제점에 대해 국외 계약조항인 FIDIC 과 AIA 의 조항은 어떻게 명시하고 있는지 비교해 보고 기존의 판례분석을 통해 도출된 쟁점과 요인에 적용시켜 봄으로써 국외 조항이 해결방안이 될 수 있는지 검증하는 과정을 시행하였다. 본 연구의 목표는 FIDIC과 AIA 조항의 판례 검증 과정을 통해 국내 공사계약일반조건의 구체화 방안을 제시하는 것이다. |
