전국토의 70%가 산지인 우리나라에서 경사지에서의 건축물의 건설은 필연적이다. 더욱이 도시의 인구 집중과 불량주거지역의 재개발 사업등으로 경사지에 많은 건축물이 세워지고 있다.??이러한 건축물들의 규제는 건축법의 건폐율, 용적률, 건축물의 높이, 층수, 건축면적 등 형태 및 규모제한 규정을 통해 이루어지고 있다.??그러나 이러한 규정의 적용을 위한 건축물의 높이, 건축면적등의 산정은 지표면을 기준으로 하고 있다.?
따라서, 이러한 규정들을 정확히 적용하기 위해서는 지표면에 대한 올바른 이해가 필수적이다. 그러나, 경사지의 경우 현행 법 규정에 의하여 지표면을 산정하기는 쉽지 않다.
이 연구는 문헌조사, 건축법규정, 건설교통부의 질의회신사례 및 지침의 검토?분석을 통해 지표면 산정규정의 문제점을 도출하고 지표면산정기준의??개선에 대한 기초자료를 제시하고자 한 것으로 연구결과는 다음과 같다.
1. 건축법에서 규정하고 있는 지표면의 관계규정은 지하층, 건축면적 및 건축물의 높이제한 규정 등이다.??이 규정은 서로 성격이 다르므로 지표면의 규정 또한 각기 다르게 정의해야 한다.
2. 경사지의 경우에 있어서 지표면의 유형을 분류?도해한 지표면 산정방법을 건설교통부 지침으로 제정하여, 일선 인?허가 관청이나 설계사무소등에서 근무하는 건축실무자들이 정확히 법규정을 적용할 수 있도록 하여야 한다. |

The building act??controls the form and size of buildings under development with the provisions of building coverage, floor area ratio, height of building, number of floors, building area etc. The height and area of a building should be measured at??the ground level.??Therefore, the ground level of a building should be crearly defined.?? In practice, however, it is??hard to??define the ground level under the current building act, especially at a sloping site. ??This study put together??the practical problems of defining the ground level by investigating the relevant articles of the building act,??official records of question and answers on the issue between practitioners and the code officials, and practical guidelines set out by the code admisistration. ??In summary, this paper proposes certain changes to the currently ambiguous definition of the ground level.??It should be defined clearly to set the ground level for each rules of basement floor, building area, building height limitations due to the purpose.??It should??be also necessary to revise relevant??provisions. |
