본 연구는 서울시의 도시계획변경 사전협상제도가 운영되어 온 과정을 관련 법령과 제도개선, 협상사례 등의 변화를 중심으로 단계별로 구분하여 살펴보고, 단계별 특징들을 분석하여 향후 제도의 보완ㆍ발전을 위한 개선방안 제시를 통해 유연한 도시계획 운영체계의 발전방향을 모색하는 것이 목적이다. 단계별 운영과정을 정리하면 1단계는 제도를 도입하면서 조례 제정을 추진하였고, 2단계는 국토계획법령을 개정하여 제도의 법적 근거를 마련하였으며, 3단계에서는 이를 반영하고 협상과정에서 나타난 문제점을 보완하여 제도의 안정화를 이루었고, 제도를 확대ㆍ발전시키기 위한 시기를 4단계로 구분하였다. 제도 운영과정에서 나타난 주요 특징으로는 첫째, 공공기여 기준의 유연화, 둘째, 관련 법령과 제도개선 및 사례적용 간 유기적 영향을 통한 상호 보완과정, 셋째, 지역 거점개발 수단으로의 점진적 발전이다. 이러한 제도적 특성을 확대ㆍ보완하기 위해서는 공공기여 기준과 적용 대상을 확대할 필요가 있고, 효율적 사업추진을 위해 다양한 사업방식의 적용방안이 마련되어야 한다. |

This study aims to find the development direction of flexible urban planning system through suggestions that can improve the operation process of the pre-negotiation system for urban planning change in Seoul Metropolitan City by stages, focusing on the change of related laws, system improvement and negotiation cases. The operation process has been developed as follows: 1) to enact the bylaw, 2) to revise law in order to establish the legal basis, 3) to stabilize the pre-negotiation system by revising the problems appeared through cases, and 4) to expand and improve the system. The main features of the operation process are characterized with the flexibility of public contribution standards, supplementary relationships between related laws and cases, and progressive improvement as a tool for growth pole development. To improve the pre-negotiation system, it is necessary to expand the scope of public contribution standards. Therefore, we can apply various development methods to promote efficient projects. |
